McCormick Barstow Attorney Successful in Medical Malpractice Defense Case
Fresno, CA (October 1, 2013) – McCormick, Barstow, Sheppard, Wayte & Carruth attorney Michael F. Ball successfully defended his physician client in an alleged post-surgical medical malpractice lawsuit.
In the case, the Plaintiff claimed that Clovis Community Medical Center and the anesthesiologist were to blame for the death of the Plaintiff’s spouse after laparoscopic gynecological surgery. The operating OB-GYN surgeon inadvertently punctured the patient’s left internal iliac artery. The Defendants, unaware of the injury or of any signs or symptoms of any problems, provided post-anesthesia care and eventually discharged the Plaintiff’s spouse home that same day. The following morning, she went into hypovolemic shock due to internal bleeding, and died. The physician settled with the Plaintiff before trial.
At the end of this three week trial in Fresno County Superior Court, the jury returned a unanimous verdict on behalf of the anesthesiologist client.
