McCormick Barstow partner Herb Stroh recently collaborated on an amicus curiae brief in the case of Barefoot v Jennings, now pending before the California Supreme Court. The case turns on an issue of standing which will have a significant impact on trust litigation in California. Herb, a member and past chair of the Executive Committee of the Trusts and Estates Section of the California Lawyers Association (“TEXCOM”), along with other executive committee members, sought and obtained approval from TEXCOM and the California Lawyers Association Amicus Committee to file the brief, citing the importance of the decision to trust litigators. The application was approved by the Supreme Court and the brief formally filed on June 10.

The case is being closely monitored by trust litigators throughout the state. TEXCOM felt that it could provide a unique perspective of this very technical area of trust law. The amicus brief is the first  ever filed by the new California Lawyers Association, and first for TEXCOM in some 20 years. A decision on the case is not expected until early 2020.
